Maintenance is based on the reasonable needs of the person claiming it, weighed against the means of the person who must pay. For children, both parents contribute in proportion to their respective incomes. The Maintenance Court can make, vary or enforce an order where parties cannot agree.
A parenting plan is a written agreement setting out how parents will share the care of and contact with their children, including living arrangements, schooling, holidays and decision-making. It can be registered with the Family Advocate or made an order of court, giving it legal force.
The guiding principle in South African law is always the best interests of the child. Parents are encouraged to agree on care and contact arrangements; where they cannot, the court will decide, often with input from the Family Advocate.
An unopposed divorce can be finalised in as little as 6 to 8 weeks, depending on court roll availability. An opposed divorce can take considerably longer, sometimes over a year, depending on the complexity of the issues involved.
