A divorce is unopposed when both spouses agree on all the terms, such as the division of assets, maintenance and arrangements for children. It is opposed, or contested, when the spouses cannot agree on one or more of these issues and the court is asked to decide.
An unopposed divorce can be finalised in as little as 6 to 8 weeks, depending on court roll availability. An opposed divorce can take considerably longer, sometimes over a year, depending on the complexity of the issues involved.
It depends largely on your matrimonial property regime, whether you are married in community of property, out of community of property, or out of community with the accrual system. We explain exactly how this applies to your situation and advise on the best approach.
For an unopposed divorce, usually only a brief appearance is required, and in many cases your attorney can handle this on your behalf. A contested divorce involves more court engagement, but we manage that process for you and keep you informed at every step.
