No. Provided the surrogacy agreement has been confirmed by the High Court before conception, the intended parents are the legal parents of the child from birth. A confirmed court order provides certainty for all parties.
Yes. South African law permits same-sex couples and single individuals to be intended parents in a surrogacy arrangement, provided all the legal requirements are met.
There is no legal requirement to use a surrogacy agency in South Africa. Many intended parents find surrogates through personal networks, support groups or online communities, and we can assist regardless of how you connect with your surrogate.
An unopposed divorce can be finalised in as little as 6 to 8 weeks, depending on court roll availability. An opposed divorce can take considerably longer, sometimes over a year, depending on the complexity of the issues involved.
It depends largely on your matrimonial property regime, whether you are married in community of property, out of community of property, or out of community with the accrual system. We explain exactly how this applies to your situation and advise on the best approach.
